These Terms & Conditions are a binding agreement between you and G. Sigurdarson(“Formbear”, “we”, “us”). By creating an account or using the service you agree to them. If you are using Formbear on behalf of an organisation, you confirm you are authorised to bind that organisation.

1. The service

Formbear is an EU-hosted form builder with a separate feedback widget. It lets you create forms, share or embed them, collect responses, and manage those responses. We may add, change, or remove features over time, and these Terms apply to every version of the service.

2. Definitions

  • Account: your Formbear login and the workspace it belongs to.
  • Workspace: the billable team space that owns forms, responses, members, and a plan.
  • Your Content: the forms, questions, settings, and other material you create in Formbear.
  • Response Data: the answers and feedback submitted to your forms and widgets by your respondents.

3. Accounts and eligibility

You must be at least 16 years old, or the age of digital consent in your country, to use Formbear. You are responsible for the accuracy of your account information, for keeping your sign-in secure, and for all activity in your workspace. Tell us promptly at [email protected] if you suspect unauthorised access.

4. Plans, billing and payment

Formbear offers a free plan and a paid plan (“Pro”). The free plan is offered as-is and may change. Pro is billed in advance on a monthly or yearly basis at the prices shown at checkout (currently €24 per month or €240 per year, excluding any applicable tax).

Payments and invoicing are handled by our billing provider, Polar, acting as merchant of record, which collects and remits applicable VAT. Subscriptions renew automatically for the same interval until cancelled. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current paid period, and access to Pro features continues until then.

Except where required by law, payments are non-refundable. We may change prices on reasonable notice; changes apply from your next renewal. If we cannot collect payment, we may downgrade your workspace to the free plan.

5. Your Content and responsibilities

You retain all rights in Your Content and Response Data. You grant us a limited, worldwide licence to host, process, and display that material only as needed to operate and support the service. We do not sell it and do not use it to train AI models.

You are responsible for ensuring that:

  • you have a lawful basis to collect, process, and store the Response Data you gather through Formbear;
  • your forms, and the way you distribute them, comply with applicable law (including data protection, consumer, and anti-spam law);
  • you provide your respondents with any notices and choices the law requires.

Where we process personal data contained in Response Data on your behalf, we do so as your processor under our Data Processing Agreement.

6. Acceptable use

Your use of Formbear must comply with our Fair Use Policy, which forms part of these Terms. We may suspend or limit accounts that breach it.

7. Privacy and data protection

Our handling of personal data is described in our Privacy Policy. Where we process personal data on your behalf, our Data Processing Agreement applies. The Data Processing Agreement and the Fair Use Policy are incorporated into and form part of these Terms.

8. Intellectual property

Formbear, including its software, design, and brand, is owned by us and our licensors. Nothing in these Terms transfers those rights to you beyond the right to use the service as permitted here.

9. Third-party services

Formbear relies on a small number of EU-based subprocessors (for hosting, email, and billing), listed in our Privacy Policy and DPA. We are not responsible for third-party services you choose to connect to your forms.

10. Availability, suspension and termination

We work to keep Formbear available and reliable but do not guarantee uninterrupted service on any plan. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the service or other users. You may stop using Formbear and close your account at any time.

On termination, we will delete or return Your Content and Response Data in line with our Privacy Policy and DPA, subject to any retention the law requires.

11. Disclaimers

Except as expressly stated and to the extent permitted by law, Formbear is provided “as is” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, revenue, or data. Our total liability arising out of or in connection with the service is limited to the amounts you paid us for the service in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify us against claims, losses, and costs arising from Your Content, your Response Data, or your breach of these Terms or applicable law.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give reasonable notice (for example by email or in-product). Your continued use after a change takes effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of Denmark, and the courts of Denmark have exclusive jurisdiction, without affecting any mandatory consumer protections available to you where you live.
